1. Acceptance of Terms

These Terms of Service (“Terms”) govern your use of the website, content, programs, and services offered by Buffalo Queen LLC (“Buffalo Queen,” “we,” “us,” or “our”), including our SMS messaging program. By accessing our website, submitting a form, enrolling in a program, or opting in to receive text messages, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our services.

2. Eligibility

You must be at least 18 years of age to use our services, enroll in our programs, or opt in to receive SMS messages. By using our services, you represent that you meet this requirement.

3. SMS / Text Messaging Program Terms

The following terms apply to anyone who opts in to receive text messages from Buffalo Queen. By providing your mobile phone number through one of our forms (for example, our contact form, consultation request, newsletter signup, course or retreat registration, or assessment) and checking the consent box (or equivalent affirmative opt-in), you expressly consent to receive SMS messages from Buffalo Queen at the number provided.

(a) Program Description

The Buffalo Queen SMS program is used to send appointment reminders, scheduling confirmations, customer-service replies, program and event updates, and (where you have opted in) promotional messages about our guidance, courses, retreats, and related offerings.

(b) Message Frequency

Message frequency varies based on your activity and the programs you have signed up for. You will not receive more messages than are reasonably necessary for the purposes described above.

(c) Message & Data Rates

Message and data rates may apply. Buffalo Queen does not charge for SMS messages, but your mobile carrier’s standard message and data rates apply to any messages sent to or from you. Check your mobile plan for details.

(d) Opt-Out (STOP)

You may cancel the SMS service at any time by replying STOP to any message you receive from us. After you send the SMS message STOP, we will send you a one-time confirmation message and you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.

(e) Help (HELP)

(f) Carrier Disclaimer

Carriers (including but not limited to AT&T, T-Mobile, Verizon, US Cellular, Sprint, Boost, Virgin Mobile, MetroPCS, and U.S. Cellular) are not liable for delayed or undelivered messages.

(g) Privacy

Information you provide in connection with the SMS program is handled as described in our Privacy Policy. We do not share mobile opt-in data or consent with third parties or affiliates for marketing or promotional purposes.

4. Programs, Guidance & Retreats

Specific terms, pricing, refund and cancellation policies, and participation requirements for our guidance programs, courses, and retreats will be provided at the time of enrollment or registration. By enrolling, you agree to those program-specific terms in addition to these Terms.

Our content, guidance, and retreats are intended for personal growth, education, and reflection. They are not a substitute for medical, psychological, psychiatric, legal, financial, or other professional advice, diagnosis, or treatment. If you are experiencing a mental-health crisis or medical emergency, please contact a qualified professional or emergency services immediately.

5. Intellectual Property

All content on this website and within our programs — including text, graphics, logos, photographs, audio, video, and course materials — is the property of Buffalo Queen or its licensors and is protected by copyright and other intellectual-property laws. You may not reproduce, distribute, modify, or create derivative works without our prior written consent.

6. User Conduct

You agree not to:

• Use our services for any unlawful purpose;
• Submit false, misleading, or harmful information;
• Attempt to gain unauthorized access to our systems or interfere with their operation;
• Use any automated means to access our website without our permission.

7. Disclaimers

Our website and services are provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the services will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

To the fullest extent permitted by law, Buffalo Queen and its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, even if advised of the possibility of such damages. Our total aggregate liability shall not exceed the amount you paid (if any) to Buffalo Queen in the twelve (12) months preceding the event giving rise to the claim.

You agree to indemnify and hold harmless Buffalo Queen, its affiliates, and their respective officers, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of our services or your breach of these Terms.

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. You agree that any dispute arising out of or relating to these Terms or our services shall be resolved exclusively in the state or federal courts located in Arizona.
